Chilson Funeral Home Payment Policy As Of January 7, 2008
TERMS: In an effort to avoid any misunderstandings with families we are serving and to ensure that both parties
understand their obligations with respect to the above referenced funeral service, we have developed this Funeral
Purchase Agreement (“Agreement”). The terms of this Agreement are as follows:
DEPOSIT: A 50% deposit is required on the total Services and Merchandise Selected (Sections I and II below).
PROFESSIONAL SERVICES; MERCHANDISE SELECTED; & CASH ADVANCE ITEMS: The remaining account balance for all Services and
Merchandise selected, including Cash Advance Items, less the deposit(s), is due and payable within thirty (30) days of
the date this Agreement is signed. The person(s) signing this Agreement (“Purchaser” or “You”) is/are jointly and severally
responsible for payment in full of all Cash Advance Items, Professional Services, Merchandise Selected, and all other Purchaser
obligations under this Agreement, including, but not limited to, late fees and collections costs.
LATE FEE AND COLLECTION COSTS: A fee of .67% (8% per annum) per month will be added to any balance outstanding thirty
(30) or more days after the date of this Agreement. The fee will be added beginning on the 31st day. Any/all balance(s)
owed beyond sixty (60) days will be turned over to a collection agency or our attorneys on the 61st day. The Purchaser is
responsible for all costs incurred in attempting to collect any balance owed under this Agreement, including, but not
limited to, attorney’s fees and costs.
MINNESOTA LAW does not require that remains be placed in a casket before or at the time of cremation. Cemeteries
may require an outer burial container. Crematory may require alternative container. Charges are only for those items
that You selected or that are required. If we are required by law or by a cemetery or crematory to use any of these
items, we will explain the reason in writing below. If You selected a funeral that may require embalming, such as
a funeral with viewing, you may have to pay for the embalming. You do not have to pay for embalming that You did
not approve, if You selected an arrangement such as a direct cremation or immediate burial.
The only warranties, express or implied, granted in connection with the goods or merchandise sold for this funeral
service are the express written warranties, if any, extended by the manufacturers thereof. There are no warranties
which extend beyond the description on the face thereof. No other warranties, expressed or implied, including the
Implied Warranty of Merchantability, and the Implied Warranty of Fitness (aka: Implied Warranty of Fitness for a
Particular Purpose), are extended by Chilson Holdings, LLC, or any of its funeral homes/chapels.
